Violation Process

Zoning Violation Process

  • Complaint is received or violation is otherwise initiated (see Complaint Guiding Document)
  • Property is inspected by staff, pictures taken and observations are saved as inspection results
  • Notice of Violation letter is sent granting the property owner 10 business days to contact our office
  • If the property owner contacts staff and reasonable accommodations can be made to bring the property into compliance, an extension letter is sent granting such time
  • If the property owner does not contact staff, the file is forwarded to the Director for review
  • The Director reviews the file
  • If the Director confirms the violation, the Notice of Intent to Proceed letter is sent by the Director
  • If the Director determines additional time is needed the case will be returned to staff for further processing
  • If the Director has sent the letter, the property owner has 10 business days to contact this office to request an Administrative Review
  • If the property owner has not requested an Administrative Review within 10 business days, the case is forwarded to the County Attorney’s Office for legal action
  • If the property owner requests an Administrative Review, a meeting is scheduled
  • The Administrative Review meeting is conducted by the Director (or appointed staff), the appropriate Compliance Officer and the property owner. At this meeting information regarding the Appeal Process through the Board of County Commissioners will be given to the property owner
  • If no unreasonable hardship can be presented, the case will be forwarded to the County Attorney’s Office for legal action
  • If the property owner can show unreasonable hardship, additional time may be granted by the Director (or appointed staff). The case will not be brought before the Administrative Review again. Once the deadline has occurred, the case will be forwarded to the County Attorney’s Office for legal action
  • Once a case has been forwarded to the County Attorney’s Office for legal action, the Investigation Fee is required (if applicable)
  • If at any time before being presented to the Magistrate, evidence can be shown that the violation is not legitimate or has been corrected, the case will be closed

PLEASE NOTE: Additional inspections are not conducted unless the property owner indicates they have brought the property into compliance or unless needed for court
